Preamble

SEOpital offers a solution designed to provide any individual or legal entity (hereinafter referred to as the “User”) with functionalities for writing content through a digital tool (hereinafter referred to as the “Service”).

This privacy policy governs the User’s visit to https://app.seopital.co/ (hereinafter referred to as the “Site”), and explains how SEOpital collects, stores, and discloses information resulting from the use of the Service (hereinafter referred to as the “Data”).

1. Introduction

SEOpital, the Site, and the Service are operated by SAS Oscar Black, a company with a share capital of 30,000€ (thirty thousand euros), registered in the Bobiny RCS under number 890 740 335, with its registered office at 7 place de l’Hotel de Ville, 93600 Aulnay-sous-Bois, France (hereinafter referred to as “SEOpital”).

SEOpital uses the Data to provide and improve the Service. By using the Service, the User agrees to the collection and use of information in accordance with this policy. Unless otherwise defined in this privacy policy, terms used in this privacy policy have the same meanings as in SEOpital’s general conditions.

Our Terms and Conditions (hereinafter the “Terms”) govern all use of the Service and, together with the Privacy Policy, any use of the Service signifies the User’s Agreement (hereinafter the “Agreement”).

2. Definitions

SERVICE: refers to the Web App https://app.seopital.co/.

THE DATA: includes both Personal Data and Usage Data.

PERSONAL DATA: means data about an individual or legal entity that can be identified from these data (or from these and other information either in possession or likely to come into possession of SEOpital).

USAGE DATA: are data collected automatically either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

COOKIES: are small files stored on the User’s device (computer or mobile device).

DATA CONTROLLER: refers to an individual or legal entity who (alone or jointly) determines the purposes and manner in which personal data are or are to be processed. For the purposes of this privacy policy, SEOpital is a Data Controller of the User’s data.

DATA PROCESSORS (OR SERVICE PROVIDERS): refers to any individual or legal entity who processes data on behalf of the Data Controller. SEOpital may use the services of various service providers to process the User’s data more efficiently.

DATA SUBJECT: is any individual or legal entity who is the subject of personal data.

THE USER: is the person using the Service. The User corresponds to the Data Subject, who is thus the subject of the Personal Data.

3. Collection and Use of Information

SEOpital collects several types of information for various purposes to provide the User with quality Service and to continuously improve it.

4. Types of Data Collected

Personal Data

When using the Service, SEOpital may ask the User to provide certain personally identifiable information that can be used to contact or identify them (hereinafter “Personal Data”). Personally identifiable information may include, but is not limited to:

(c) User’s company name

(d) Company’s postal address

SEOpital may use these Personal Data to contact the User in order to provide them with necessary information related to the use of the Service. Usage Data

SEOpital may also collect information that the User’s browser sends whenever they visit the Site or when they access the Service via or through a mobile device (hereinafter “Usage Data”).

This Usage Data may include information such as the computer’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of the Service that the User visits, the time and date of their visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

When the User accesses the Service with a mobile device, these Usage Data may include information such as the type of mobile device used, the mobile device’s unique identifier, the mobile device’s IP address, the mobile operating system, the type of mobile Internet browser used, unique device identifiers, and other diagnostic data.

Tracking & Cookies Data

SEOpital uses cookies and similar tracking technologies to track activity on the Site and Service and hold certain information.

Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to the User’s browser from a website and stored on their device. Other tracking technologies are also used such as beacons, tags, and scripts to collect and track information and to improve and analyze the Site and the Service.

The User can instruct their browser to refuse all cookies or to indicate when a cookie is being sent. However, if they do not accept cookies, they may not be able to use some portions of our Service.

Examples of Cookies that SEOpital uses:

(a) Session Cookies: SEOpital uses Session Cookies to operate the Service.

(b) Preference Cookies: SEOpital uses Preference Cookies to remember the User’s preferences and various settings.

(c) Security Cookies: SEOpital uses Security Cookies for security purposes.

(d) Advertising Cookies: Advertising Cookies are used to serve the User with advertisements that may be relevant to them and their interests.

5. Use of Data

SEOpital uses the collected data for various purposes:

(a) to provide and maintain the Service;

(b) to notify the User about changes to the Service;

(c) to allow the User to participate in interactive features of the Service when they choose to do so;

(d) to provide customer support to the User;

(e) to gather analysis or valuable information so that SEOpital can improve the Service;

(f) to monitor the usage of the Service for compliance purposes;

(g) to detect, prevent, and address technical issues;

(h) for SEOpital to perform the obligations and enforce the rights arising from any contracts entered into between it and the User, including for billing and collection;

(j) to provide the User with notices about their account and/or subscription, including expiration and renewal notices, email instructions, etc.;

(k) to provide the User with news, special offers, and general information about other goods, services, and events offered by SEOpital unless the User opts not to receive such information;

(l) in any other way SEOpital may describe when the User provides the information;

(m) for any other purpose with the User’s consent;

(n) to enable SEOpital to issue invoices to the User as part of the provision of Services.

6. Data Retention

SEOpital will retain the Data only for as long as is necessary for the purposes set out in this privacy policy.

SEOpital will retain and use the User’s Personal Data to the extent necessary to comply with legal obligations, resolve disputes, and enforce legal agreements and policies.

SEOpital will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of the Service, or SEOpital is legally obligated to retain this data for longer time periods.

7. Data Transfer

The User’s information, including Personal Data, may be transferred to — and maintained on — computers located outside of the User’s state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of the User’s jurisdiction.

The User’s consent to this privacy policy followed by their submission of such information represents their agreement to that transfer.

SEOpital will take all steps reasonably necessary to ensure that the User’s data is treated securely and in accordance with this privacy policy and no transfer of the User’s Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of the User’s data and other personal information.

8. Disclosure of Data

SEOpital may disclose the Personal Data collected or provided:

(a) Disclosure for Law Enforcement Purposes.

Under certain circumstances, SEOpital may be required to disclose the User’s Personal Data if required by law or in response to valid requests by public authorities.

(b) Other Cases.

SEOpital may also disclose the User’s information:

• to its subsidiaries and affiliated companies;
• to achieve the purpose for which the User has provided them;
• with your consent in all other cases;
• if SEOpital believes that disclosure is necessary or appropriate to protect the rights, property, or safety of the company, its customers, or others.

9. Data Security

SEOpital commits to exerting its best efforts to ensure the security of the User’s Personal Data.

In this sense, SEOpital cannot be held responsible in the event that the User’s Data is disclosed or deleted due to situations beyond the reasonable efforts that can be implemented by SEOpital to ensure data security, such as, for example:

• the accidental or criminal destruction of SEOpital’s servers;
• hacking of SEOpital’s servers by malicious individuals;
• etc.

10. User’s Rights in Data Protection under the General Data Protection Regulation (GDPR)

If the User is a resident of the European Union (EU) and the European Economic Area (EEA), they have certain rights in data protection, covered by the GDPR. To learn more, the User can visit the site https://eur-lex.europa.eu/eli/reg/2016/679/oj.

SEOpital strives to take reasonable measures to allow the User to correct, modify, delete, or limit the use of their Personal Data.

If the User wishes to be informed of the Personal Data that SEOpital holds about them and if they want it to be deleted from SEOpital’s systems, the User can send an email to idriss@seopital.co.

Under certain circumstances, the User has the following rights in data protection:

(a) the right to access, update, or delete the information SEOpital holds about them;

(b) the right to rectification. The User has the right to have their information rectified if it is inaccurate or incomplete;

(c) the right to object. The User has the right to object to SEOpital processing their Personal Data;

(d) the right to restriction. The User has the right to request that SEOpital restricts the processing of their Personal Data;

(e) the right to data portability. The User has the right to receive a copy of their Personal Data in a structured, commonly used, and machine-readable format;

(f) the right to withdraw consent. The User also has the right to withdraw their consent at any time as SEOpital relies on the User’s consent to process their Data.

SEOpital reserves the right to verify the User’s identity before responding to such requests. It is possible that SEOpital may not be able to provide the Service without certain necessary data.

The User has the right to file a complaint with a Data Protection Authority regarding SEOpital’s collection and use of their Data. For more information, the User can contact the local data protection authority in the European Economic Area (EEA).

11. Service Providers

SEOpital may employ third-party companies and individuals to facilitate the Service (Service Providers), to provide the Service on its behalf, to perform Service-related services, or to assist it in analyzing how the Service is used.

These third parties have access to the User’s Data only to perform these tasks on behalf of SEOpital and are obligated not to disclose or use it for any other purpose.

12. Analysis of Usage Data

SEOpital may use third-party service providers to monitor and analyze the use of Service Data.

Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

13. Payments

The User pays SEOpital for the use of the Service, with the frequency and amount set in advance of their access to the Service.

SEOpital does not store or collect the User’s bank account or IBAN details. This information is provided directly to its third-party payment processors whose use of the User’s Data is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

14. Links to Other Sites

The Service may contain links to other sites that are not operated by SEOpital. If the User clicks on a third-party link, they will be directed to that third party’s site. SEOpital strongly advises the User to review the Privacy Policy of every site they visit.

SEOpital has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites or services.

15. Privacy of Minors

The Service is not intended for use by minors under the age of 18 (hereinafter “Minors”).

SEOpital does not knowingly collect personally identifiable information from Minors under 18. If the User realizes that a Minor has provided us with Personal Data, they can contact us. If SEOpital becomes aware that it has collected Personal Data from a Minor without verification of parental consent, SEOpital will take steps to remove that information from its servers.

16. Changes to This Privacy Policy

SEOpital may update our privacy policy at any time. SEOpital will notify the User of any changes by posting the new privacy policy on the Site.

SEOpital will notify by email and/or a prominent notice on our Site, prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy.

SEOpital recommends that the User review this Privacy Policy periodically for any changes. Changes to this privacy policy are effective when they are posted on the Site.
